AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Minerva Distinguished Skincare, Inc. ("Company", “we”, “us”, or “our”), concerning your access to and use of the www.MinervaDSC.co website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

By agreeing with these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

SECTION 1 - REGARDING OUR PRODUCTS

Product information

All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right at sole discretion to modify or discontinue any product at any time without notice at any time for any reason.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Product information is provided for convenience and is not intended to diagnose, treat or prevent disease. It is not a substitute for medical advice. Information is based on general knowledge and is not meant as any type of ‘health claim’.

Our products should be used in accordance with their instructions, precautions and guidelines. Although the ingredients are natural, it is still possible to have an allergic reaction. Therefore, always check the ingredients of our products to avoid potential allergic reactions.

Minerva Distinguished Skincare nor its owner(s) cannot be held responsible for any adverse results or reactions from the use of products, product ingredients or other instructions or suggestions mentioned in this website.

We do not guarantee that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, nor that any discrepancies in the Service will be rectified.

Natural

Our formulas are made with organic and/or natural ingredients It is acceptable in the skincare industry to have varying definitions for ‘natural’ used for natural skincare. We define an ingredient as natural to include natural derived, natural identical or purely natural (example avocado oil). It is our sole discretion to make changes at any time to this definition without notification to You. It is your sole responsibility to read Terms of Services for any changes.

Variations

Three things beyond our control that may cause product variations. These variations are considered normal and do not impact product performance. You agree to accept these variations as normal for product use and not product quality issues.

Natural ingredients may have slight variations vary from batch to batch. As an example, the time of year a natural ingredient is harvested may impact the color and thus may impact the color of the finished product. This is considered normal for the products.
Shipping in warmer temperatures may affect the appearance of the natural product. How long the product is on the warm delivery truck or on someone’s front door is beyond our control. Once the product has reached room temperature for a couple of hours or so, the appearance will change to a more normal (as ‘normal’ for the product) state. The good news is this will not affect the performance of the product.
We take reasonable care to make sure that the details, descriptions, prices and images on our website are correct, but we can’t guarantee that everything on the site is error-free. Our website product photos capture our very best effort to show the color and texture of our products. These photos are for illustrative purposes only and the product you receive may not match exactly the to the photo. Additionally, we cannot guarantee that your computer monitor's display of colors will be accurate.

Shelf-life

We make our products in small batches and do not stock a large inventory. This method aids with ensuring you are receiving a fresh product.

The product shelf life from the order date is 9-12 months.

It is solely your responsibility to determine continual use of the products beyond product shelf life.

SECTION 2 - REGARDING PRICING

All product pricing is United States currency, and all payments must be made in US currency. Product prices do not reflect sales tax and shipping. Applicable sales taxes will be applied to all orders and will be calculated and displayed prior to submitting an order. The total order cost calculated will be processed at the time an order is submitted.

You authorize us to charge your preferred payment method for any relevant shipping fees as well as all charges for your purchases at the pricing in place at the time of your order. Even if we have already asked for or received payment, we reserve the right to fix any typos or pricing inaccuracies.

SECTION 3 -REGARDING ORDERS

Once an order is submitted, the buyer will receive an order confirmation email with an order number. The confirmation will be sent to the email address provided on our website.

Orders cannot be cancelled by the buyer once confirmation is received.

Minerva Distinguished Skincare reserves the right at any time to reject or cancel an order.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we will attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

SECTION 4 - REGARDING SHIPPING

We ship from Arkansas to only within the United States. Our mail carrier is United States Post Office and we have flat-rate shipping as specified on each of our product pages. On occasion, we may opt to offer free shipping which will be shown on our website or offered to only our email subscribers using a specific discount code.

Unless otherwise specified on our website, orders will be shipped 1-3 business days from the date the order is received. The expected delivery date under normal conditions is 3-4 business days after it is shipped. Keep in mind unsafe roads for delivery trucks due to weather conditions, holidays or weekends may impact the travel time of your package. These conditions are beyond our control.

A tracking number will be sent to the email address provided for the order once the package is mailed.

The shipping address provided by the buyer is considered correct and valid. If the address provided was incorrect and the package was delivered to the address provided, we cannot be responsible for not receiving shipment. However, if the package is returned as non-deliverable, we will try to notify the buyer of the issue. It will be the buyer’s option to (1) have the package delivered to the correct address with new shipping charges or (2) a refund issued to the card used for payment less the original shipping charges, plus 3% of the total order for administration fees. If a refund is issued, you will receive a notification via the email you used to make your purchase. Please remember the time it takes for your bank or credit card company to process and post the refund to your account is beyond our control.

SECTION 5 - REGARDING PERSONAL INFORMATION

Your submission of personal information through the Site is governed by our Privacy Policy.

By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use.

SECTION 6 - REGARDING RETURNS

We provide as much detailed information as we can, so the buyer is aware of what they are buying.

However, returns are accepted under specific conditions.

SECTION 7 - REGARDING FAULTY PRODUCT

We strive to consistently produce and deliver quality products. We take great care to package your items to prevent issues during transit. However, it may be possible that even with our best efforts, an issue may occur that results in faulty products.

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. Please contact us as soon as possible and no later than 24 hours of delivery, via our Contact Us form.

SECTION 8 - REGARDING SUBMISSIONS

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site or our products provided by you, whether online, by email, by postal mail, or otherwise, to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

SECTION 9 - REGARDING ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our Site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We do not accept cancellations.

Prices for all products are subject to change at our sole discretion. From time to time, our Site will reflect price changes per product as necessary.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.
